This Privacy Policy (“Policy”) covers Ix Art Park owned and operated websites and mobile applications (collectively “Sites”), and any other services offered by Ix Art Park that post a link to this Privacy Policy including exhibitions, entertainment services, motion pictures and animations, consumer products and interactive services (“Services”). Ix Art Park refers to Ix Art Park Foundation and its subsidiaries and affiliated entities (“we,” “us,” or “our”).

By using the Services and/or Sites, you agree to the collection and use of information in accordance with this Policy. Unless otherwise defined in this Privacy Policy, terms used in this Privacy Policy have the same meanings as in our Terms of Use. This Policy describes the types of information we gather from people visiting our Sites and from individual users (“you”, “your” or “users”) interacting with the Services, and how we use, transfer, and secure such information.

Types of Information We Collect and Use
Information You Provide
While using our Sites and Services, we may ask you to provide us with certain Personal Information. “Personal Information” is information that can be used to identify you, directly or indirectly. The types of information we collect include:

For example, our cameras may record you walking within an exhibit, and we may play back the image in front of a green screen or on monitors within the exhibit. By visiting an exhibit, you are providing your consent for us to record and use your likeness within the exhibit.

Content, including content within any messages you send to us (such as feedback and questions to customer support) or publicly post on the Service (such as in product reviews or blog comments).

Employment Data, including your employment and education history, transcript, writing samples, and references as necessary to consider your job application for open positions.

Information about Others
We may also collect and store personal information about other individuals that you provide to us. If you use our website to send others (friends, relatives, colleagues, etc.) a product as a gift, information that may interest them, or messages (such as invitations) through our system, we may store your personal information and the personal information of each such recipient. Similarly, if you use our website to upload, share and/or distribute content (including videos, comments, or other submissions), and such content contains personal information about others, such information may be stored in order to allow for such uploading, sharing and/or distribution. By providing such information, you acknowledge and agree that both you and the other individuals are based in the U.S. and that you have their consent for us to use their information in accordance with this Privacy Policy.
Information Collected Automatically
We automatically collect information when you use or interact with the Sites, including as follows:
Log Data
We automatically collect information that your browser or mobile device sends whenever you or your users visit or use our Sites (“Log Data”). This Log Data may include information such as your computer’s Internet Protocol (“IP”) address, browser type, browser version, device ID or another unique identifier, the pages of our Service that you visit, the time and date of your visit, the time spent on those pages, and other statistics.
The types of tracking technologies we use to collect this information include:
Cookies. Cookies are files with a small amount of data, which may include an anonymous unique identifier. Cookies are text files placed in your computer’s browser to store your preferences. Cookies, by themselves, do not tell us your email address or other personally identifiable information. However, they do allow third parties, such as Google and Facebook, to cause our advertisements to appear on your social media and online media feeds as part of our retargeting campaigns. If and when you choose to provide our Site with personal information, this information may be linked to the data stored in the cookie. Cookies are sent to your browser from a website and stored on your computer’s hard drive.
We use “cookies” to collect information. You can instruct your browser to refuse all cookies or to indicate when a cookie is being sent. However, if you do not accept cookies, you may not be able to use some portions of our Service.
Web Beacons. Web beacons (also known as Clear GIFs) are small pieces of code placed on a web page to monitor the visitor’s behavior and collect data about the visitor’s viewing of a web page. For example, web beacons can be used to count the users who visit a web page or to deliver a cookie to the browser of a visitor viewing that page.

Use of Information
We collect, hold, use and disclose your information in accordance with the practices described in this Privacy Policy, including for the following purposes:

These service providers may be used for the purpose of enabling them to provide their services, including (without limitation) IT service providers, data storage, web-hosting and server providers, debt collectors, maintenance or problem-solving providers, marketing or advertising providers, professional advisors, and payment systems operators. Where we disclose your personal information to service providers, we will request or ensure that the service provider handles your personal information solely for the purpose of performing the services for us, although we may permit them to use information that does not identify you (including information that has been aggregated or de-identified) for any purpose except as prohibited by applicable law;

By entering a promotion, you agree to the official rules that govern that promotion, and may, except where prohibited by applicable law, allow the sponsor and/or other entities to use your name, voice, and/or likeness in advertising or marketing materials.

Analytics and Advertising
We may use analytics services such as Google Analytics that collect, monitor and analyze information on our behalf. Google provides tools to allow you to opt out of the use of certain information collected by Google Analytics at https://tools.google.com/dlpage/gaoptout.
In addition, we work with agencies, advertisers, ad networks, and other technology services to place ads about our products and services on other websites and services. For example, we place ads through Google and Facebook that you may view on their platforms as well as on other websites and services. We may incorporate tracking technologies into our Sites (including our website and emails) as well as into our ads displayed on other websites and services. Some of these tracking technologies may track your activities across time and services for purposes of associating the different devices you use and delivering relevant ads and/or other content to you (“Interest-based Advertising”).
The companies we work with to provide you with Interest-based Advertising are required by us to give you the choice to opt-out of receiving targeted ads. Most of these companies are participants of the Digital Advertising Alliance (“DAA”) and/or the Network Advertising Initiative (“NAI”). Communications
We may use your information to contact you with newsletters, marketing or promotional materials, and other information that may be of interest to you. You may opt-out of receiving any, or all, of these promotional communications from us by emailing us at info@ixartpark.org, or following the unsubscribe link or instructions provided in any email we send. Please note that you cannot opt-out of non-promotional emails, such as those about your account, transactions, servicing, or our ongoing business relations.
Do Not Track
Your browser settings may allow you to automatically transmit a “Do Not Track” signal to the online services you visit. Note, however, there is no industry consensus as to what site and app operators should do with regard to these signals. Accordingly, unless and until the law is interpreted to require us to do so, we do not monitor or take action with respect to “Do Not Track” signals. Your Controls and Choices
We provide you the ability to exercise certain controls and choices regarding our collection, use, and sharing of your information. In accordance with applicable law, your controls and choices may include:

Links to Other Websites and Public Postings
Our Sites may contain links to other websites. We do not have any control over those websites, and we are not responsible for the protection and privacy of any personal information which you provide whilst visiting those websites. Those websites are not governed by this Privacy Policy. If you chose to share information publicly through our Sites or Services, please understand that we cannot control the actions of third parties who could access or collect this information.

Visitors That Reside Outside the United States
Ix Art Park provides its Sites and Services for the purpose of creating an enjoyable experience for its customers within the United States. The laws governing the collection and use of information within the United States may be different from the laws of your country. If you decide to use our Site or Services or share your Personal Information with Ix Art Park, you are agreeing to be governed by the laws of the United States, and you are expressly consenting to the transfer of your data to the United States and other jurisdictions.
Children and Privacy
We do not knowingly collect personal information (as defined by the Children’s Online Privacy Protection Act (“COPPA”) from children under the age of 13 in connection with the features of our Sites or Services without the consent of a parent or guardian. If you are a parent or guardian and believe we have collected personal information in violation of COPPA, contact us at info@ixartpark.org. We will remove the personal information in accordance with COPPA. If you are using our Site or Services on behalf of a child under the age of 13, including purchasing a Pass for a child under the age of 13, you must either be that child’s parent or guardian or have the permission of that child’s parent or guardian, to supply the required information.
Storage and Security
In order to prevent unauthorized access or disclosure, we have put in place suitable physical, electronic, and managerial procedures such as encryption of certain personal information, designed to safeguard and secure personal information and protect it from misuse, interference, loss, and unauthorized access, modification and disclosure.
However, we cannot guarantee the security of any information that is transmitted to or by us over the Internet. The transmission and exchange of information is carried out at your own risk. Although we take measures to safeguard against unauthorized disclosures of information, we cannot assure you that the personal information we collect will not be disclosed in a manner that is inconsistent with this Privacy Policy.
The security of your use of an Ix Art Park Sites relies on the protection of your mobile device. You may not share your instance of the mobile application with anyone. If you believe that unauthorized access to your instance of the mobile application has occurred, please report it immediately at info@ixartpark.org. You must promptly notify us if you become aware that any information provided by or submitted to the mobile application is lost, stolen, or used without permission.
We will never ask you to send your password or other sensitive information to us in an email, though we may ask you to enter this type of information on an Ix Art Park website, or mobile application interface.
Any email or other communication purporting to be from one of our websites requesting your password or asking you to provide sensitive account information via email should be treated as unauthorized and suspicious and should be reported to us immediately by emailing info@ixartpark.org.
We will retain your personal information for the length of time needed to fulfill the purposes outlined in this privacy policy unless a longer retention period is required or permitted by law.
Will Ix Art Park Change This Privacy Policy?
We may, at any time and at our discretion, revise this Privacy Policy by posting an updated version. Any amended Privacy Policy is effective upon posting of the revised Privacy Policy. If the changes are material, we may notify you by contacting you through the contact details you have provided to us or through a notice on the Site.

Nevada law (NRS 603A.340) requires each business to establish a designated request address where Nevada consumers may submit requests directing the business not to sell certain kinds of personal information that the business has collected or will collect about the consumer. A sale under Nevada law is the exchange of personal information for monetary consideration by the business to a third party for the third party to license or sell the personal information to other third parties. Additional Disclosures for California Residents.
These additional disclosures apply only to California residents. The California Consumer Privacy Act of 2018 (“CCPA”) provides additional rights to know, delete, and opt-out, and requires businesses collecting or disclosing personal information to provide notices and means to exercise rights.

Right to Know and Delete
You have the right to know certain details about our data practices in the past 12 months. In particular, you may request the following from us:

If we are unable to verify your identity, we may deny your requests to know or delete.
Authorized Agent
You can designate an authorized agent to submit requests on your behalf. However, we will require written proof of the agent’s permission to do so and verify your identity directly.
Right to Non-Discrimination
You have the right not to receive discriminatory treatment by us for the exercise of any your rights.

Customers who are residents of California may request (i) a list of the categories of personal information disclosed by us to third parties during the immediately preceding calendar year for those third parties own direct marketing purposes; and (ii) a list of the categories of third parties to whom we disclosed such information. To exercise a request, please write us at the email or postal address set out above and specify that you are making a “California Shine the Light Request.” We may require additional information from you to allow us to verify your identity and are only required to respond to requests once during any calendar year.
